Terms of Service
Purpose of the Service
Kluup (kluup.app) is a party game web app designed to break the ice and create genuine human connections at in-person gatherings (aperitifs, parties, team buildings, etc.). The service works in host + players mode: the host creates a session, participants join from their browsers via a room code, no installation required.
Access and Free Use
Access to Kluup is free and open. A Google account is optional and only allows saving cross-session statistics and accessing one's profile. Free access to three themes is available with no payment or commitment. An optional one-time purchase unlocks the premium themes, as described in Article X below.
Minimum Age
The Kluup service is reserved for persons aged **18 and over**. Some content is of an adult nature (the "Unmasked" theme). By using this service, the user declares on their honour that they are 18 or older. The publisher cannot be held responsible for use by minors.
Expected Behaviour
Users agree to: • Respect other participants and not use the service for harassing, discriminatory, defamatory or illegal purposes. • Not attempt to compromise the technical operation of the service. • Understand that Kluup is a social catalyst, the publisher does not control the verbal exchanges that take place outside the application. Any use contrary to these commitments may result in suspension of access.
Limitation of Liability
The publisher is not responsible for the responses, behaviours, statements or actions of players outside the application. The service is provided "as is", without guarantee of continuous availability, absence of errors or fitness for a particular purpose. The publisher shall not be held liable for direct or indirect damages resulting from the use or unavailability of the service.
Intellectual Property
The Kluup brand, source code, design and question content are the exclusive property of the publisher. Any partial or total reproduction, representation, modification, publication or adaptation of these elements, by any means whatsoever, is prohibited without prior written authorisation from the publisher.
Affiliate Links
Some articles on the Kluup blog contain affiliate links to products sold by third parties (notably Amazon). As an Amazon Associate, the publisher may earn a commission on qualifying purchases made through these links, at no extra cost to the user. These links are clearly identified as such and do not affect the editorial independence of the content: games and products are recommended on the basis of their value to the user.
Modification and Suspension of the Service
The publisher reserves the right to modify, suspend or discontinue the service at any time, without notice, in particular for technical, maintenance or service development reasons. In the event of substantial changes to these Terms, a notice will be published on the site. Continued use of the service after publication of the new Terms constitutes acceptance thereof.
Applicable Law and Dispute Resolution
These Terms are governed by French law. In the event of a dispute, an amicable solution will be sought first. Failing agreement, the user may have recourse to consumer mediation (mediator contact: contact@kluup.app) or the European Online Dispute Resolution (ODR) platform: https://ec.europa.eu/consumers/odr Failing amicable resolution, the French courts shall have jurisdiction.
Premium Access (one-time purchase)
X.1. Nature. "Premium" access is digital content: the permanent unlock, for the buyer's account, of all paid themes on Kluup. This is a one-time, lifetime purchase with no subscription or renewal. X.2. Price and payment. The displayed price is quoted in euros, all taxes included. Payment is processed by our provider Stripe; Kluup does not collect or store any bank-card data. X.3. Immediate access and waiver of the right of withdrawal. Premium access is delivered immediately upon payment confirmation. By completing the purchase, the buyer expressly requests immediate performance of the service and expressly acknowledges waiving their 14-day right of withdrawal (pursuant to Directive 2011/83/EU, art. 16(m)). Accordingly, the purchase is non-refundable. X.4. No voluntary refund. Given the waiver above and the existence of a free tier allowing the game to be tried before any purchase, no refund is granted in the event of a change of mind. X.5. Statutory guarantee of conformity. Clause X.4 does not affect the statutory guarantee: if, due to a malfunction attributable to Kluup, the paid Premium access is not delivered, the buyer may request that it be fixed or, failing that, refunded, by writing to contact@kluup.app. X.6. Payment disputes. In case of disagreement, the buyer is invited to contact contact@kluup.app before initiating any chargeback procedure with their bank.
